James practices in the areas of commercial disputes, insolvency and leasing.
James has been with RBHM as a consultant solicitor since June 2005. James was previously a partner for 10 years at Baker and McKenzie (one the world’s largest firms) and practiced there for 16 years. James has been admitted as a solicitor in NSW since 1982.
James has negotiated, litigated, attended mediations and advised both Australian and International clients on a wide range of commercial issues, including:
- IT implementation disputes;
- Misleading conduct claims;
- Contract interpretation, breach, termination and damages assessment issues;
- Distributorship issues;
- Joint venture disputes;
- Professional negligence claims;
- Partnership disputes;
- Debt collection and related securities enforcement;
- Guarantee drafting and enforcement;
- Retention of Title (ROT) drafting and enforcement;
- Directors statutory and fiduciary duties;
- Trust disputes and equitable remedies such as injunctions;
- Fraud;
- Shareholder disputes, including oppression relief; and
- International trading disputes;
James has advised and conducted litigation for insolvency practitioners, creditors, directors and debtors on a wide range of insolvency issues, including:
- Voluntary Administrations;
- Deeds of Company Arrangement;
- Receiverships;
- Winding-up Proceedings;
- Liquidations;
- Public Examinations;
- Voidable Transactions;
- Insolvent Trading;
- Security Enforcement Issues;
- ASIC actions; and
- Bankruptcies
James has acted for landlords and tenants on many commercial leases including retail shops.
James has lectured on insolvency and disputes issues at external and internal seminars. He has also published papers in the IPAA journal. He is a member of the Law Council Insolvency Committee, the Commercial Law Association, Insol and the Insolvency Practitioners Association.
James lives on the North Shore and is married with 2 children. His interests include surfing, skiing, running and tennis.
